Terms of Service.
Last updated: 2 July 2026
These terms govern your use of The Automation Division’s website and services. By engaging with us — whether that’s filling in a contact form, booking a call, or signing up for a project — you agree to these terms.
If you’re a client, a formal engagement will also involve a separate Services Agreement that covers the specifics of your project. These Website Terms sit alongside that. In the event of any inconsistency, the Services Agreement prevails.
1. About us
The Automation Division is a business process automation and integration consultancy based in Lake Macquarie, NSW, Australia.
ABN: 97 884 264 495
Email: hq@automationdivision.com.au
Phone: (02) 4950 4326
2. Our services
We provide automation consulting, workflow integration, and related services to small and medium businesses. Our services typically follow this structure:
- A free 20-minute discovery call to understand what you need
- A paid audit or scoping phase before any build work begins
- Quoted project work for integrations and automations
- Optional ongoing support arrangements
Every project is scoped and quoted upfront. We don’t charge for work we haven’t agreed on, and we don’t spring surprises on invoices.
3. Intellectual property
What we build is yours. Upon full payment, you own the deliverables we create for you — the workflows, integrations, documentation, and configurations. There are no ongoing license fees, no proprietary lock-in, and no hidden strings.
We retain the right to use the general knowledge, skills, and methodologies we developed or used during your project. We may also, with your permission, reference your project (anonymously) as a case study or portfolio example.
Any third-party tools or platforms we integrate have their own licenses, which you either already have or agree to obtain. Those terms are between you and the provider.
4. Your responsibilities
You agree to:
- Provide accurate and timely information about your systems and needs
- Grant reasonable access to the tools and systems involved in your project
- Pay invoices by the agreed terms
- Not use our services for anything unlawful
We can’t build something that works if we don’t have accurate information about what you need. Delays caused by incomplete or inaccurate information may affect timelines and pricing.
5. Fees and payment
Fees are quoted in Australian dollars (AUD) and are exclusive of GST unless stated otherwise. Payment terms are specified in your invoice or Services Agreement.
Typical terms: 50% upfront for project work, balance on completion. Ongoing support is billed monthly in arrears.
6. Cancellation
You can cancel at any time. You’ll be invoiced for work completed up to the cancellation date, and any prepaid but unearned amounts will be refunded. Ongoing support arrangements can be cancelled with 30 days’ notice.
7. Limitation of liability
We build things carefully and stand behind our work. However, to the extent permitted by Australian consumer law, our liability is limited to the amount paid for the specific service giving rise to the claim.
We are not liable for indirect or consequential losses — for example, lost revenue, data loss, or business interruption — unless caused by our gross negligence or wilful misconduct.
Nothing in these terms excludes or limits any rights you have under the Australian Consumer Law that cannot be excluded or limited.
8. Confidentiality
We treat your business information as confidential. We won’t share it with third parties (except as needed to deliver your project) or use it for purposes outside our engagement with you. This obligation survives the end of our relationship.
9. Website use
Our website is provided for general informational purposes. While we do our best to keep it accurate and up to date, we make no guarantees about completeness or currency.
This website may link to third-party sites. We’re not responsible for their content or practices.
10. Dispute resolution
If a dispute arises, we’ll try to resolve it informally first — a phone call or a coffee usually sorts things out. If that doesn’t work, the dispute will be handled under the laws of New South Wales, Australia.
11. Changes to these terms
We may update these terms from time to time. The most current version will always be on this page. Continued use of our services after a change means you accept the updated terms.
